Regulatory advisory grounded in real projects

Regulations and Certification for BESS Projects

For investors, portfolio operators, and asset managers – clarity on regulatory obligations, before they become a problem

EVERY REGULATORY REQUIREMENT BACKED BY A SPECIFIC PROVISION

We classify your project’s regulatory status, allocate responsibility between you and your aggregator, advise on certification for the balancing market, and check compliance with Capacity Market obligations – and where a provision is ambiguous, we say so directly instead of guessing.

WHO WE WORK WITH:

International investors

Poland’s regulatory and certification procedures differ from what you’ll know from other markets – you need a local partner who knows them from the inside.

Operators of multi-project portfolios

The more installations you run, the harder it becomes to manually track each project’s classification status and upcoming deadlines.

C&I companies with their own storage system

NIS2/KSC compliance and Capacity Market obligations apply to smaller, industrial-scale installations too, not just utility-scale projects.

Asset managers

A project in operation remains subject to evolving regulatory obligations – you need someone tracking compliance long-term, not only during construction.

SCOPE OF SUPPORT:

Classification and compliance

  • NIS2/KSC regulatory classification – determining the entity’s status (key or important) with regard to the wider corporate group structure, not just the individual project company
  • NC RfG equipment compliance – confirming that PCS units and inverters are certified and listed on the PTPiREE register
  • SCADA/EMS supplier evaluation standard – regulatory compliance criteria used when selecting an integrator, not the physical implementation of security measures
  • Capacity Market obligations – compliance of metering and settlement against the auction certificate, including multi-year obligations

Route to market and certification

  • Responsibility matrix – a clear allocation of regulatory obligations between you and your aggregator or optimiser, with the legal basis for each assignment
  • Aggregator/optimiser selection and Route to Market – reviewing and comparing offers, supporting contract negotiations, and aligning the contracted scope of responsibility with the matrix
  • Advisory on balancing market certification – the full DUB pathway from a regulatory perspective: balancing unit vs. schedule unit, communication systems with PSE (LFC/SOWE/WIRE), and FIT/SIT/Dry Run test requirements

HOW WE WORK:

  1. REGULATORY CLASSIFICATION
We determine your project’s status (key or important entity, SGU), taking the wider corporate group structure into account, not just the individual project company.
  2. RESPONSIBILITY MATRIX
We allocate obligations between you and your aggregator or optimiser – each requirement assigned to a specific party, with its legal basis.
  3. ROUTE TO MARKET PARTNER SELECTION
We collect and compare offers from aggregators and optimisers, support contract negotiations, and make sure the contracted scope of responsibility matches the matrix from step 2.
  4. CERTIFICATION ADVISORY
We advise at every stage of the DUB/POB process from a regulatory standpoint: documentation preparation, interpreting PSE test requirements, and support in obtaining the certificate.
  5. OPEN ITEMS REPORT
Where a provision is ambiguous and requires direct confirmation from the regulator, we say so directly instead of guessing.

WHY WORK WITH US:

Every requirement backed by a specific provision

We cite the article of the statute or regulation, not a generality.

Open items, not false certainty

Where something can’t be resolved without a direct query to PSE or the regulator, we say so plainly.

Responsibility matrix

A clear division of obligations between you and your aggregator or optimiser – essential when negotiating the contract.

Independence

We assess regulatory compliance – we don’t sell hardware or IT services.

EXAMPLES OF OUR SUPPORT:

NIS2/KSC classification for a BESS project portfolio

Responsibility matrix for a project with a contracted optimiser

Aggregator selection and Route to Market contract negotiation
